1. Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms and Conditions ("Terms") and any additional terms and conditions referenced herein. If you do not agree to all of these Terms, you should not use our services.

WAVE 9 Air Inc provides HVAC Services/Maintenance., consultation, project management, technical support. We reserve the right to modify or discontinue the service at any time without notice.
3. User Responsibilities
You must provide accurate and complete information when using our services.
You agree to use our services only for lawful purposes and in accordance with these Terms.
4. Payment Terms
Services are billed on day work of scope is completed. Monthly, quarterly payments are only allowed if Wave 9 Air agrees in writing.
- All fees must be paid in advance unless otherwise agreed in writing.
- Late payments may incur interest or service suspension.
5. Cancellation and Refunds
You may cancel your service subscription by providing [7 ] days' written notice. Refunds will be considered on a case-by-case basis and are not guaranteed unless otherwise stated in our refund policy.
6. Intellectual Property
All content, trademarks, and data provided by Wave 9 Air inc are our property or the property of our licensors and are protected by copyright and other intellectual property laws.
7. Limitation of Liability
In no event will Wave 9 Air inc be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use our services.
8. Indemnification
You agree to indemnify and hold harmless Wave 9 Air inc, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of your use of the services or your violation of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.
10. Changes to Terms
Wave 9 Air inc reserves the right to update or change these Terms at any time without notice. Continued use of the service after any such changes shall constitute your consent to such changes.
OUR SERVICE CALL TERMS & CONDITIONS
Proper installation of a HVAC VRF (Heating, Ventilation, Air Conditioning - Variable Refrigerant Flow) system is critical for several reasons:
Importance of Proper Installation
1. Efficiency VRF systems are known for their energy efficiency. Correct installation ensures that the system operates at optimal performance levels, leading to significant energy savings over time.
2. Comfort Proper setup guarantees even distribution of conditioned air throughout the building, maintaining consistent comfort levels regardless of external weather conditions or internal load variations.
3. Durability Correct installation practices extend the life of the equipment by reducing wear and tear. This includes correct sizing of components, proper refrigerant charging, and ensuring all connections are secure.
4. Safety Improper installation can lead to refrigerant leaks, which not only reduces system efficiency but can also be hazardous if the refrigerant is not managed properly, potentially leading to health risks or environmental damage.
5. Noise Reduction VRF systems can be quieter when installed correctly, with noise levels managed through proper placement of outdoor units and balancing of indoor units.
6. Compliance Adhering to local building codes and manufacturer specifications during installation ensures the system is legally compliant, which can be crucial for both residential and commercial installations.
Consequences of Improper Installation and Service/Maintenance.
1. Reduced Efficiency Incorrectly installed systems might consume more energy, negating the benefits of choosing a VRF system, which could lead to higher utility bills.
2. Poor Comfort Levels Issues like uneven cooling or heating, drafts, or temperature swings can occur, leading to discomfort for occupants.
3. Frequent Repairs Improper installation can lead to premature breakdown of components, necessitating frequent and potentially costly repairs.
4. System Failures Incorrect refrigerant charge or poor connections might result in system malfunctions or even complete system failures, which could be expensive to fix.
5. **Safety Hazards**: A system not installed according to safety standards might leak refrigerant, posing risks to health and safety.
6. Voided Warranty Many manufacturers will void warranties if the system is not installed according to their guidelines, leaving owners liable for repair costs.7. Legal Issues Non-compliance with local regulations can lead to fines or mandatory system corrections at the owner's expense.
HVAC Service Policy – Equipment Not Installed by Our Company
Effective immediately, the following policy applies to all service, diagnosis, repair, and maintenance work performed on heating, ventilation, and air-conditioning systems that were not designed, supplied, or installed by our company.
1. No Responsibility for Pre-Existing Equipment
We are not the original installing contractor and therefore assume no responsibility for:
- The design, sizing, installation quality, or prior workmanship of the equipment or system
- Any latent defects, improper installation, inadequate maintenance, or age-related wear that existed before our arrival
- Claims that “it never did that before” our technicians arrived
Any condition discovered during our service visit is considered pre-existing unless we caused demonstrable new damage through proven negligence.
2. Labor Warranty Policy
Because we did not design or install the equipment:
- No labor warranty is provided on any diagnostic, repair, or maintenance work performed on systems installed by others.
- Parts we supply may carry the manufacturer’s parts-only warranty (if applicable and transferable), but labor to install, replace, or service those parts is not warranted.
- We reserve the absolute right to decline any request for free or discounted return labor related to equipment we did not originally install.
3. Scope of Service
All work is performed on a time-and-materials or quoted basis for the condition of the system as found. Our technicians will document the existing condition of the equipment before beginning work. Customers acknowledge that:
- We cannot guarantee the long-term performance of a system whose original installation is outside our control.
- Further failures, inefficiencies, or the need for additional repairs may arise from underlying issues unrelated to our service.
4. Customer Acknowledgment
By authorizing service, the customer accepts this policy in full. A copy of this policy is available upon request and is considered part of our standard terms of service.We are happy to evaluate systems we did not install and will always provide honest recommendations. However, we cannot assume liability or offer labor warranties for work performed on equipment outside our original scope of installation. Thank you for your understanding.
